The Loi sur la mise en marché des produits agricoles, alimentaires et de la pêche
This Act provides a framework for the marketing of agricultural and food products in Quebec.
The Régie des marchés agricoles et alimentaires du Québec (RMAAQ), a specialized administrative tribunal and an economic policy organization, is in charge of administering the Act. The Régie holds certain regulatory powers, and especially that of settling disputes that may arise in the marketing of agricultural and fish products.
The Act provides farmers with the freedom to apply for a joint plan in order to collectively organize the production and marketing of their products.
Thanks to their joint plans, groups of producers are able to control the production and marketing of their products. For example, they are able to centralize sales, impose production quotas, establish quality criteria, finance promotional activities, etc. They are also able to hold collective negotiations with buyers. The Act stipulates that buyers are under obligation to comply when called to a collective negotiation. The Act provides for conciliation and arbitration in the event that no agreement can be reached.
