Marketing agreement
The Loi sur la mise en marché obliges all individuals involved in the marketing of a product that is covered by a joint plan to negotiate the conditions of the marketing of the product with the organization that administers the joint plan. This agreement must be ratified by the Régie des marchés agricoles et alimentaires du Québec.
In the event that an agreement cannot be reached, the Loi sur la mise en marché (Act governing marketing) provides for conciliation, and ultimately, arbitration by the Régie des marchés agricoles et alimentaires.
Once an agreement is reached with the majority of the product buyers, the Régie can then extend the agreement to apply to all buyers, whether they have endorsed it or not.
In the case of the maple syrup industry, the marketing agreement determines the conditions governing the marketing of bulk maple syrup harvested in 2007 and 2008.
